SB 661: Support Senators Nichols and Hegar on PUC Sunset

The Public Utility Commission of Texas (PUC) has helped ensure continued reliability in the state while overseeing the successful competitive market. SB 661 continues that practice by:

  • Giving the PUC tools for better oversight and removes out-of-date regulatory hurdles.
  • Increasing the PUC’s administrative penalty authority to $100,000 per violation per day for electric industry participants’ violations of ERCOT’s reliability protocols or PUC’s wholesale reliability rules.
  • Authorizing the PUC to issue emergency cease-and-desist orders to deter harmful activity by electric industry participants.
  • Moving the regulation of water utilities from TCEQ to PUC.
  • Combining responsibility for regulating water and wastewater rates and certificates of convenience and necessity with existing utility regulation at PUC.
  • Strengthening the PUC’s oversight of ERCOT.
  • Making ERCOT subject to future Sunset reviews, concurrent with reviews of the PUC.
  • Increasing representation by independent members of the ERCOT Board.
